Terms of service
In force since 2026-10-26.
These terms are the agreement between you and Fluent by Now ("Fluent by Now", "we") for the use of fluentbynow.com, schools.fluentbynow.com, the live class screen and the emails we send. By opening an account, joining a class or using the site you accept them. The privacy policy explains what we do with your data and is part of this agreement.
1. What Fluent by Now is
A language course with two teachers: an AI teacher available at any hour (lessons, exercises, role plays, texts, games, corrections) and, where a school or a teacher uses the platform with you, a human teacher who sets homework, sees your progress and joins live classes. Courses exist in Portuguese, English, Spanish, French, German and Russian. We improve the service continuously and may add, change or remove features.
2. Accounts
- You sign in with a link sent to your email address; there is no password. Keep your mailbox safe: whoever reads your email can open your account. "Remember this browser" keeps you signed in for 30 days from your last visit.
- One account per person, with your own email address. You may use it on several devices.
- You can open an account on your own from 16. Younger learners use Fluent by Now through a school, with a parent's or guardian's consent collected by the school, or with that consent sent to us.
- You can end your account at any time with Delete my account on your dashboard. Everything in it is deleted at once and cannot be recovered.
3. Invite codes, free days and invite links
- A new learner joins with an invite code, which opens a number of free days of lessons. When the days end, the lesson closes until a new code, a school's class or a plan opens it again; your progress stays.
- Every learner has an invite link. A friend who joins with it receives free days, and so do you, up to a limit shown on your dashboard. The link is for people you know; posting it where strangers pick it up, inviting yourself or inventing accounts cancels the days earned, and may close the accounts involved.
- Free days and codes have no cash value, cannot be sold and may be changed or withdrawn by us; days already granted stay.
4. Fair use
- Premium voices and video avatars come with a monthly allowance per learner; past it, the lesson continues with a standard voice until the next month.
- Use the service to learn a language. Do not use it to generate illegal, hateful or sexual content, to harass anyone, to extract our lessons, texts and exercises in bulk, to probe or overload our systems, or to let others use your account.
- A class link is for the people the teacher invites. Do not share it with others.
- Photograph pages of books, worksheets, menus and signs, not people. Only upload material you may use for your own learning.
5. The AI teacher
Marta, Tiago, Anna and the other teachers are an AI system (see the privacy policy). They are good at practising with you, but:
- Their corrections, explanations, texts and level estimates can be wrong or incomplete. We work on it every week, and we cannot promise the absence of errors.
- They are not a substitute for a qualified teacher where a certificate, an exam or a decision depends on it. Where a human teacher takes part, the human teacher has the final word.
- The voices and the video characters are synthetic and are marked as such. The characters in role plays play a part; what they say is fiction for practice.
6. Content
- The lessons, texts, exercises, songs' arrangements, images, code and design of Fluent by Now are ours or licensed to us. You may use them for your own learning; you may not copy, resell or publish them.
- What you write, say or photograph in a lesson stays yours. You allow us to process it to teach you, including through our AI providers, as the privacy policy describes. We do not use it to train AI models, and our providers may not either.
- Material a teacher makes for a school (texts, exercise sets, courses) belongs to that school for its own teaching on the platform.
7. Schools
- A school's account is opened by the teacher who becomes its manager, who accepts these terms on the school's behalf and can hand the school to another teacher.
- The school decides what it teaches and who it invites, sees its students' progress and engagement as described in the privacy policy, and is responsible for obtaining the consent of parents or guardians for minors it invites.
- Trials are free for the period shown when the school opens; teacher and manager seats are free. Paid plans, allowances and prices are agreed with the school in writing.
- A data processing agreement for the students' data is available on request.
8. Availability and changes
We aim to keep the service up at all times, but it depends on our providers and on the internet, and we may pause it for maintenance. We may change these terms; when a change matters, we show the new date on this page and tell you on the dashboard or by email at least two weeks before it applies. If you do not accept a change, delete your account before that date.
9. Liability
We provide the service with care and skill. To the extent the law allows, we are not liable for indirect losses, for decisions you or a school take on the basis of the AI teacher's output, for a failure of a provider or of the internet, or for an amount above what you paid us in the twelve months before the event (or €50 if you paid nothing). Nothing here limits our liability for intent, gross negligence, death or personal injury, or the rights consumers have under the law of the country where they live.
10. Ending the agreement
You can end it at any time by deleting your account. We can suspend or close an account that breaks these terms, after a warning unless the breach puts the service or other people at risk, and we can close the service as a whole with at least thirty days' notice, during which you can download your data.
11. Law and disputes
Portuguese law applies, without taking from you the protection of the mandatory consumer rules of the country where you live if you are a consumer elsewhere in the EU. Please write to us first; most things are solved with an email. Consumers in Portugal may also use the electronic complaints book at livroreclamacoes.pt and the alternative dispute resolution bodies listed at consumidor.gov.pt. Otherwise the courts of Lisbon have jurisdiction, unless the law gives you the right to your own courts.
